PHOTOGRAPHY & VIDEOGRAPHY SERVICE AGREEMENT
This Agreement is made between Magaña Photography (hereafter referred to as "Service Provider") and the undersigned individual or organization (hereafter referred to as "Client") for the purpose of providing photography and/or videography services for a church event, concert, choir performance, or similar occasion. The services, terms, and conditions outlined below apply to all engagements between the Service Provider and Client.

SERVICES TO BE PROVIDED
The Service Provider agrees to provide photography and/or videography services for the specified church event, concert, or performance.
The services may include:
Live event photography
Videography of performances
Capturing key moments such as solos, group performances, and audience reactions
Behind-the-scenes content (if requested)
Edited video production or individual clips (as agreed upon)
PAYMENT TERMS & DEPOSIT
A 50% non-refundable deposit is required at the time of booking to secure the event date and is credited toward the total fee.
The remaining balance is due upon delivery of the final photos or videos.
Payments may be made via Credit Card, Zelle, Apple Pay, Cash App, Venmo, or Cash. A receipt will be provided.
If the Client requests additional services beyond the agreed package (e.g., additional hours, extra deliverables), these will be charged at a rate of $200 per hour per service or as per the updated package.
If the event is canceled by the Client, the deposit is non-refundable. In cases of Force Majeure (outlined below), the Photographer may choose, at their discretion, to refund the deposit or reschedule services.
AUDIO RECORDING (For Videography Services)
To ensure high-quality audio capture, designated speakers, choir leaders, or performers may be requested for the final video product.
Purpose: To record clear audio of performances, sermons, and key speeches.
Consent: By signing this agreement, all recorded individuals consent to the use of their audio for the final video product.
CANCELLATION POLICY
If the event is rescheduled, efforts will be made to accommodate the new date, subject to availability.
If the Service Provider cancels due to unforeseen circumstances, a full refund will be issued, including the deposit.
DELIVERABLES & TIMELINE
Photos: Unlimited edited digital photos will be delivered via an online gallery within 2 weeks.
Video: Edited video will be delivered within 3 weeks (as per the agreed scope of work).
All files will be available for a period of 30 days and then will be deleted for storage optimization.
The Service Provider will store final edited media for one year from the event date. After this period, retrieval may be subject to an additional fee.
GALLERY ACCESS
Additional individuals or parties (referred to as "Guests") may be granted access to an online gallery at the discretion of the Main Client. However, all images and videos available to Guests will contain watermarks. Guests will have the option to purchase non-watermarked images if desired.
MAIN CLIENTS & GUEST ACCESS
Main Clients: The primary contracting party (referred to as the "Main Client") will receive full access to all final images and videos in high resolution, free of watermarks. The Main Client will have the right to download and use the delivered files for personal or organizational purposes, as outlined in this agreement.
Guest Access: Additional individuals or parties (referred to as "Guests") may be granted access to an online gallery at the discretion of the Main Client. However, all images and videos available to Guests will contain watermarks. Guests will have the option to purchase non-watermarked images if desired.
Usage & Distribution: The Main Client is responsible for ensuring that any distributed files comply with this agreement. Unauthorized sharing of non-watermarked files with third parties not covered under this agreement negatively impacts the Photographer/Videographer’s business and ability to sustain high-quality services. To protect both parties, redistribution of non-watermarked files outside of permitted use is strictly prohibited unless explicitly approved by the Photographer/Videographer.
CLIENT RESPONSIBILITIES
The Client must provide access to the venue, including necessary permissions for filming and photography.
The Client must obtain any necessary approvals from the church, choir, performers, or other involved parties for media capture.
An itinerary or program must be provided before the event to ensure key moments are covered.
MEDIA RELEASE AND USAGE
The Client grants the Photographer permission to use photos and videos for portfolio, website, promotional materials, and other commercial purposes unless otherwise requested in writing.
All individuals appearing in the media release the Photographer from any claims related to the usage of images.
COPYRIGHT & USAGE
The Service Provider retains the copyright to all images and videos taken.
Redistribution of non-watermarked files beyond permitted use is strictly prohibited unless explicitly approved by the Photographer.
LIABILITY
The Service Provider is not responsible for any injuries, damages, or issues arising from the event, except in cases of proven negligence.
In case of emergency, equipment failure, or unforeseen circumstances beyond control, liability is limited to the amount paid under this contract.
FORCE MAJEURE
Neither party shall be liable for failure to perform obligations due to unforeseen circumstances, including but not limited to acts of God, natural disasters, war, or government restrictions.
DAMAGE TO EQUIPMENT
The Client is responsible for any damage to the Service Provider’s equipment caused by negligence or intentional acts by the Client or their guests.
If damage occurs, the Client agrees to cover repair or replacement costs.
TRAVEL AND ACCOMMODATION COSTS
If the event requires travel beyond 60 miles from the Service Provider’s base location, the Client agrees to cover travel expenses, including transportation, lodging, and meals if necessary.
ASSISTANT PHOTOGRAPHER
If the Service Provider is unavailable for any reason, an assistant photographer may be assigned to cover the event.
The assistant will work under the Service Provider’s direction to maintain quality and standards.
ADDITIONAL HOURS / OVERTIME
If the event exceeds the scheduled time, additional fees of $200 per hour will apply.
The Photographer will notify the Client during the event if overtime is necessary.
BACKUP & DATA PRESERVATION
While every effort is made to safeguard photos and videos, the Service Provider is not responsible for data loss after delivery.
Clients are advised to create backups upon receiving their media files.
RESERVATION OF TIME
Upon signing this agreement, the Service Provider will reserve the event time and date, ensuring exclusive booking.
ENTIRE AGREEMENT
This agreement constitutes the entire understanding between the parties. Any modifications must be in writing and signed by both parties.
