Engagement Photography Agreement
This agreement is made between Kristopher Magaña (Magaña Photography) and the undersigned individual (the "Client") for engagement photography services on the date specified below.
Services Provided
The Photographer agrees to provide professional engagement photography services, including vision development, candid and posed photography, and professional post-production editing. The Client will receive an online gallery with high-resolution edited images.
Deposit & Payment
A non-refundable deposit of 50% of the total amount is required to secure your date and time. This deposit covers pre-session planning and ensures your booking.
The remaining balance is due before the delivery of any photos.
Payment Methods: Payments can be made via Venmo, CashApp, Zelle, Apple Pay, or Cash.
Rescheduling & Cancellation
Client-Initiated Reschedule: If the Client needs to reschedule, they must provide at least 14 day notice. The deposit will be applied to the new date, subject to the Photographer’s availability.
Client Cancellation: The deposit is non-refundable in the event of cancellation.
Photographer Cancellation: If the Photographer must cancel due to unforeseen circumstances, all fees paid will be refunded, or the Photographer will assist in finding a replacement.
Session Duration & Location
The session will last for the agreed-upon time as outlined in the package selected.
Travel fees apply to locations 60 miles outside of Fresno, CA.
Delivery of Photos
Allow 3-4 weeks for delivery of fully edited engagement photos.
Expedited editing (2 weeks) is available for an additional fee.
All images will be delivered via an online gallery with high-resolution downloads.
Access to the gallery will be available for 30 days.
Gallery Access & Usage
The Main Client will receive full access to all final high-resolution images.
The Main Client may share the gallery with family and friends. Any images available for guests may contain watermarks, and non-watermarked versions will be available for purchase.
Copyright & Usage Rights
The Photographer retains the copyright to all photographs.
The Client is granted a personal use license, allowing them to print and share images for personal and wedding-related use.
The images may not be sold or used for commercial purposes without written permission.
Client Responsibilities
The Client is responsible for selecting a location for the session (or choosing from the Photographer’s recommended locations).
The Client must ensure timely arrival for the scheduled session. If the Client is more than 15 minutes late, time may be deducted from the session.
The Client should plan outfits accordingly and follow any pre-session preparation guidelines provided by the Photographer.
Creative License & Editing
The Photographer has full creative discretion over the images taken, including editing style, posing, and composition.
The Client understands that specific shots cannot be guaranteed, as lighting, weather, and other environmental factors may impact the session.
Raw Files & Editing Requests
The Photographer does not provide raw, unedited images.
Media Release & Portfolio Use
The Photographer may use selected images for portfolio, website, social media, and marketing purposes unless the Client requests otherwise in writing.
Force Majeure
If the session must be canceled due to uncontrollable events (e.g., extreme weather, natural disasters), the deposit will be transferred to a rescheduled date.
Dispute Resolution
Any disputes arising from this agreement will first be attempted to be resolved through amicable negotiation between both parties.
Entire Agreement
This agreement constitutes the entire understanding between the Photographer and the Client. No other agreements, verbal or written, shall override the terms herein.
