Professional Portrait Photo Agreement
Session Details: The session includes the agreed-upon package. The client will have access to the specified number of edited photos, and additional photos may be available for purchase.
Payment: A non-refundable deposit of 50% is required to secure your booking. This deposit serves as a retainer for the photographer's time and preparation. The remaining balance is due at the time of photo delivery. Payments can be made via Venmo, CashApp, Zelle, Apple Pay, or Cash.
Rescheduling and Cancellations: Cancellations are only allowed if caused by circumstances beyond our control (e.g., illness, weather, or other emergencies). In such cases, the session will be rescheduled, and the deposit will be applied to the new session. Rescheduling can be done based on availability.
Late Arrival: Clients are expected to arrive on time for their scheduled session. Late arrivals may result in a shortened session time.
Image Delivery: Edited photos will be delivered within the stated turnaround time. Additional editing requests or extra photos may incur extra charges.
Main Clients: The primary contracting party (referred to as the "Main Client") will receive full access to all final images and videos in high resolution, free of watermarks. The Main Client will have the right to download and use the delivered files for personal or organizational purposes, as outlined in this agreement. All files will be available for a period of 30 days before being deleted for storage optimization.
Guest Access: Additional individuals or parties (referred to as "Guests") may be granted access to an online gallery at the discretion of the Main Client. However, all images and videos available to Guests will contain watermarks. Guests will have the option to purchase non-watermarked images if desired.
Usage & Distribution: The Main Client is responsible for ensuring that any distributed files comply with this agreement. Unauthorized sharing of non-watermarked files with third parties not covered under this agreement negatively impacts the Photographer/Videographer’s business and ability to sustain high-quality services. To protect both parties, redistribution of non-watermarked files outside of permitted use is strictly prohibited unless explicitly approved by the Photographer/Videographer.
Rights and Usage: The client grants Magaña Photography the right to use the images for promotional purposes unless otherwise specified in writing. If opting out, clients must notify the photographer before the session.
Assistant Photographer: Client understands that if the Service Provider is unavailable for any reason, an assistant photographer may be assigned to cover the event or occasion. The assistant photographer will operate under the direction of the Service Provider to ensure the quality and standards of service are maintained.
Client Responsibility: Clients are responsible for their outfit choices and securing any necessary permissions for chosen locations. Magaña Photography is not liable for access issues at the location.
Liability Release: The photographer is not responsible for any personal injury, property damage, or loss during the session, whether on location or in transit.
Force Majeure: In the event the photographer is unable to perform services due to an emergency, illness, or unforeseen circumstances beyond their control, a full refund of the deposit will be issued, or the session will be rescheduled at a mutually agreed time.
