Proposal Photography Agreement

This agreement is made between Kristopher Magaña (Magaña Photography) and the undersigned individual (the "Client") for professional proposal photography services on the date specified below.

Services Provided

The Photographer agrees to provide professional photography services for a marriage proposal, including candid and posed shots before, during, and after the proposal. All images will be professionally edited and delivered via an online gallery.

Deposit & Payment

  • A non-refundable deposit of 50% of the total amount is required to secure your date and time.

  • The remaining balance is due before the delivery of final photos.

  • Payment Methods: Payments can be made via Venmo, CashApp, Zelle, Apple Pay, or Cash.

Rescheduling & Cancellation

  • Client-Initiated Reschedule: The Client must provide at least 72 hours' notice if a reschedule is needed. The deposit will be applied to the new date, subject to the Photographer’s availability.

  • Client Cancellation: The deposit is non-refundable in the event of cancellation.

  • Photographer Cancellation: If the Photographer must cancel due to unforeseen circumstances, all fees paid will be refunded, or the Photographer will assist in finding a replacement.

Proposal Coordination

  • The Photographer will work with the Client to plan the best location, timing, and positioning to capture the proposal.

  • Any vendor recommendations, permit handling, or additional planning assistance must be discussed in advance and may incur additional fees.

Session Duration & Location

  • The session includes time for the proposal, candid post-proposal moments, and optional mini engagement portraits.

  • Travel fees apply to locations 40 miles outside of Fresno, CA.

Delivery of Photos

  • Final, professionally edited photos will be delivered within 2-3 weeks.

  • A sneak peek (select photos) will be provided within 48 hours.

  • Expedited full gallery delivery (within 1 week) is available for an additional fee.

  • Photos will be delivered via an online gallery with high-resolution downloads.

  • All files will be available for a period of 30 days and then will be deleted for storage optimization.

Gallery Access & Usage

  • The Client will have full access to the online gallery for downloading and sharing images.

  • Guests may have access to a separate gallery with watermarked images, with an option to purchase non-watermarked versions.

Unauthorized sharing of images is prohibited.

Copyright & Usage Rights

  • The Photographer retains the copyright to all photographs.

  • The Client is granted a personal use license, allowing them to print and share images for personal use.

  • The images may not be sold or used for commercial purposes without written permission.

Client Responsibilities

  • The Client must ensure timely arrival and coordination for the proposal.

  • If the Client is more than 15 minutes late, time may be deducted from the session or require rescheduling (subject to availability and additional fees).

  • The Client should communicate any special requests or key moments they want captured.

Creative License & Editing

  • The Photographer has full creative discretion over the images taken, including editing style, posing, and composition.

  • Specific shots cannot be guaranteed, as lighting, weather, and environmental factors may impact the session.

Raw Files

  • The Photographer does not provide raw, unedited images.

Media Release & Portfolio Use

  • The Photographer may use selected images for portfolio, website, social media, and marketing purposes unless the Client requests otherwise in writing.

Force Majeure

  • If the session must be canceled due to uncontrollable events (e.g., extreme weather, natural disasters), the deposit will be transferred to a rescheduled date.

Dispute Resolution

  • Any disputes arising from this agreement will first be attempted to be resolved through amicable negotiation between both parties.

Entire Agreement

  • This agreement constitutes the entire understanding between the Photographer and the Client. No other agreements, verbal or written, shall override the terms herein.
